When a foreign person sells U.S. real estate, FIRPTA generally requires the buyer to withhold a percentage of the sales price. A Form 8288-B withholding certificate application can, in appropriate cases, request a reduced or eliminated withholding amount based on the expected tax. Filing Form 8288-B does not automatically eliminate the buyer’s withholding obligation unless the applicable rules and timing are satisfied. We do not guarantee that the IRS will approve a certificate or issue it within any particular time, and processing times are outside our control. We prepare and support the application accurately; the outcome depends on the facts and on IRS processing.

What is Form 8288-B for?
It is the application for a withholding certificate. In appropriate cases it requests that the FIRPTA withholding be reduced or eliminated based on the seller’s expected U.S. tax on the sale, rather than the default percentage of the sales price.
Can FIRPTA withholding be reduced?
Sometimes. Where the expected tax is less than the default withholding, a withholding certificate application may request a reduced amount. Approval is not guaranteed and depends on the facts and IRS review.
Does the seller need an ITIN?
A U.S. taxpayer identification number is generally required for the parties to the application and the related filings. We coordinate ITIN applications where needed.
Who is responsible, the buyer or the seller?
FIRPTA places the withholding obligation on the buyer or transferee, while the seller reports the sale and any refund on a U.S. return. We coordinate both sides within the agreed scope.
Is IRS approval guaranteed?
