How many years back do I need to file?
It depends on the facts. IRS administrative guidance says enforcement of filing requirements is normally pursued for a six-year period (IRM 5.1.11.7.1(5)), and IRS personnel may enforce more or fewer years with managerial approval. That is an enforcement policy rather than a universal requirement. We pull your transcripts and confirm which years are actually open.
What if I do not have my records?
That is common and usually workable. We retrieve your IRS wage and income transcripts, which show data from information returns such as Forms W-2, 1098, 1099 and 5498. They do not contain deductions, basis, business expenses or state information, so they are combined with prior returns, bank records and any bookkeeping that exists. Where something genuinely cannot be reconstructed, we tell you before the return is prepared.
Will I get in trouble for unfiled taxes?
For most ordinary non-filers, coming forward and filing voluntarily is the constructive way to deal with it, and being current on filing is generally expected before payment or relief options are considered. Where there is possible criminal exposure or a question of willfulness, a tax attorney should be involved. This is general information, not legal advice.
The IRS filed a return for me. Can you fix it?
Usually we can address it. A substitute return is prepared without the exemptions, credits and deductions you may be entitled to receive. Filing your own delinquent return for that year lets those items be claimed, and the IRS states it will generally adjust your account to reflect the correct figures. Whether that lowers the balance depends on your actual facts.
What if I cannot pay what I owe?
Filing and paying are separate questions. Once the returns are filed the real figures are known, and payment options such as an installment agreement, or other resolution alternatives, can be evaluated against your circumstances. Interest and the failure-to-pay penalty continue to apply while tax remains unpaid, and no arrangement can be assumed to be approved in advance.
